Terms of use

These terms cover your use of Estate Sale Zone (“we”, “us”). By using the site you agree to them. Our privacy policy explains how we handle your information.

What Estate Sale Zone is

Estate Sale Zone is a directory of estate, garage, yard and moving sales, free to browse. We don't run, host or sell at any of the sales listed, and we aren't part of any purchase. Anything you buy, and any dealings at a sale, are between you and the seller or the company running it.

Listings can be wrong

Most listings come from estate sale companies' websites and public garage sale posts, and some are posted by sellers directly. We work to keep them accurate and take down sales that have ended or been removed, but dates, times, addresses, photos and descriptions can be out of date or wrong, and sales can be cancelled. Check the original listing, linked on each sale, before you go. If something's wrong, use “Report a problem” on the listing.

Visiting a sale is at your own risk. Be careful at private homes, respect the seller's rules and property, and obey parking and traffic laws.

Your account

You need an account only to save sales and searches. Keep your password to yourself; you're responsible for what happens under your account. You must be at least 13 to create one. You can stop using the site at any time, and ask us to delete your account by emailing hello@estatesalezone.com.

Posting a sale

When you post a sale, you agree that:

• It's a real, one-off sale that you run or have the right to advertise, and the details are accurate.
• You own the photos you upload, or have permission to use them.
• Nothing in it is illegal, unsafe, misleading or offensive, including recalled or prohibited items, weapons that can't legally be sold this way, or anything stolen.
• Its details, including the address and any phone number you add, will be shown publicly.

You keep ownership of what you post. You give us permission to show, store, copy, resize and share it (for example, in previews when someone shares your sale) for as long as it's on the site, to run and promote Estate Sale Zone. We may edit a listing for format, hold it until its address can be confirmed, or remove it at any time, for example if it breaks these terms.

Using the site fairly

Please don't:

• Post spam, fake sales or ads for businesses that aren't sales.
• Use the site to harass, stalk or harm anyone, or to plan a crime at a listed address.
• Try to break into accounts or our systems, or disrupt the site, including by overloading it with automated requests.
• Pretend to be someone else, or post someone else's private information.

We may suspend or close accounts that do these things.

Emails

If you save a search, we'll email you when new sales match it. You can pause or stop those emails at any time from your saved searches or the link in each email. We also email you the day before a sale you saved starts; you can turn that off on your saved sales page or from any reminder. The newsletter is separate and only sent if you sign up for it.

The Paid plan

Browsing and the Free plan are free. The Paid plan is a subscription at the price shown on your plan page when you upgrade, charged through Stripe at the start of each billing period until you cancel. It renews automatically.

You can cancel any time from your plan page. Paid then lasts to the end of the period you've paid for, and you won't be charged again. Payments aren't refunded for part of a period, except where the law requires. If a payment fails, Paid stays on while Stripe retries it; if it can't be collected, your account returns to Free and saved searches past the Free limit are paused, not deleted. If we change the price, we'll email you before it applies to your next renewal.

Content and takedowns

The site's design, code and name are ours. Listings belong to the people and companies who wrote them, and each one links to its source. If you believe something on Estate Sale Zone infringes your copyright or shouldn't be here, email hello@estatesalezone.com with a link to it and we'll review it promptly. Estate sale companies can also opt out of being listed.

No warranty

Estate Sale Zone is provided “as is” and “as available”. To the extent the law allows, we make no promises that the site will always be available, error-free, or that listings are accurate or complete.

Limit of liability

To the extent the law allows, we aren't liable for indirect or consequential losses, or for anything that happens at a sale or between you and a seller, and our total liability to you for any claim about the site is limited to $100. Some places don't allow these limits, so they may not apply to you.

Changes

We may update these terms. We'll change the date at the top, and tell account holders by email about significant changes. Using the site after a change means you accept the new terms.

Law

These terms are governed by the laws of the State of California.
